Minnesota State Statute on Alcohol (Minn. Stat. § 340A.503)

Summary:

It is illegal to consume any alcoholic beverages under age 21.

Exception: It is an affirmative defense if the alcohol was consumed in the household of your parent or guardian with their consent.

It is illegal to drink in a liquor store or bar if under age 21.
It is illegal to sell, barter, furnish or give alcohol to persons under 21 years of age.
It is illegal for a person under 21 years of age to attempt to purchase any alcoholic beverage.
It is illegal for a person under 21 years of age to attempt/purchase alcohol using another’s ID/a “fake” ID.
It is illegal a person under the age of 21 years to possess any alcoholic beverage with the intent to consume it at a place other than the household of the person's parent or guardian.
It is illegal for a person under the age of 21 years to enter an establishment licensed for the sale of alcoholic beverages or any municipal liquor store for the purpose of purchasing or having served or delivered any alcoholic beverage.

Exceptions:

-May enter while working at the establishment.

-May enter to consume meals only.

-May enter to attend social functions that are held in a portion of the establishment where liquor is not sold.

It is unlawful for a person under the age of 21 years to claim to be 21 years old or older for the purpose of purchasing alcoholic beverages.
You are legal to consume alcohol as of 8:00a.m. on the date of your 21st birthday. (I.e., you may not go drinking at 12:01a.m. on your birthday, “power hour” or the like.)
Proof of age is only allowed by one (or more) of the following:

o A valid driver's license or identification card issued by Minnesota, another state, or a province of Canada, and including the photograph and date of birth of the licensed person

o A valid military identification card issued by the United States Department of Defense

o A valid passport issued by the United States

o A valid instructional permit issued under section 171.05 to a person of legal age to purchase alcohol which includes a photograph and the date of birth of the person issued the permit

o In the case of a foreign national, by a valid passport

A licensed retailer of alcohol/municipal liquor store may seize suspected false identification with reasonable suspicion and must turn over the seized ID to law enforcement within 24 hours.
Immunity/Amnesty: A person under 21 is not subject to prosecution if they call a 911 operator to report themselves or another person in need of medical assistance for an immediate health or safety concern, provided:

o The person calling is the first (and up to two others acting in concert with the initiator) to make contact with authorities;

o Provides their name and contact information;

o Remains at the scene until emergency personnel arrive; and

o Cooperates with authorities at the scene.

o Any person who receives medical assistance under the above conditions is also immune from prosecution.
